Copyright Policy

P Digital Network ("PDN", "we", "us", or "our") respects the intellectual property rights of artists, creators, and rights holders. This Copyright Policy outlines how we handle copyright-related matters on our platform, including how to submit a copyright infringement claim and how we respond to such claims. We are committed to protecting original works and ensuring that all content distributed through our service is properly authorized.

01 Our Commitment to Copyright

P Digital Network is a music distribution platform that serves independent artists, labels, and content creators. We take copyright protection seriously and operate in compliance with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) and international copyright treaties.

We require all users who upload or distribute content through our platform to confirm that they own or have the necessary rights, licenses, consents, and permissions to distribute such content. Uploading content that infringes the rights of others is a violation of our Terms of Service and may result in account termination.

02 What is Copyright Infringement?

Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.

Examples of copyright infringement on our platform include:

  • Uploading and distributing music that you did not create and do not have rights to distribute.
  • Using samples, beats, or melodies from another artist's work without a valid license.
  • Re-uploading or redistributing another artist's released tracks under a different name.
  • Using copyrighted album artwork, photos, or visual content without authorization.
  • Distributing cover songs without obtaining the required mechanical license.
  • Claiming ownership of content that belongs to another rights holder.

03 DMCA Takedown Notice

If you believe that your copyrighted work has been distributed through our platform without authorization, you may submit a DMCA takedown notice to us. To be valid, your notice must include the following information:

  • Your full legal name and contact information (email address, phone number, and mailing address).
  • A description of the copyrighted work you claim has been infringed.
  • The specific URL(s) or location(s) on our platform where the infringing content is located.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature.

04 Our Response to Takedown Notices

Upon receiving a valid DMCA takedown notice, P Digital Network will:

  • Review the notice to confirm it meets all legal requirements.
  • Remove or disable access to the allegedly infringing content promptly.
  • Notify the user who uploaded the content that a takedown has been filed.
  • Forward a copy of the takedown notice (with your personal information redacted where possible) to the uploader.
  • Document the takedown for our internal records in compliance with DMCA requirements.

We aim to respond to all valid takedown notices within 3–5 business days.

05 Counter-Notification

If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  • Your full name, address, telephone number, and email address.
  • Identification of the content that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts in Bangladesh and that you will accept service of process from the person who submitted the original takedown notice.
  • Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within the applicable timeframe, we may restore the removed content at our discretion.

06 Repeat Infringer Policy

P Digital Network has a strict policy against repeat copyright infringers. In accordance with the DMCA and our Terms of Service, we will terminate the accounts of users who are found to be repeat infringers.

Specifically:

  • A user who receives two or more valid copyright infringement notices may have their account suspended pending review.
  • A user who receives three or more confirmed copyright violations will have their account permanently terminated.
  • All distributed content associated with terminated accounts will be removed from all platforms.
  • Any outstanding royalty payments may be withheld pending investigation.

07 Content ID & Rights Management

P Digital Network uses rights management systems, including YouTube Content ID and other platform-specific tools, to help rights holders identify and manage their content across digital platforms.

When you distribute your music through P Digital Network:

  • Your content may be registered with Content ID systems on YouTube and other platforms.
  • Any unauthorized use of your music on these platforms may be automatically detected and claimed.
  • Revenue generated from Content ID claims will be collected and reported in your royalty statements.
  • You may instruct us to monetize, track, or block unauthorized uses of your content.

If you believe a Content ID claim has been filed incorrectly against your content, please contact us so we can investigate and resolve the issue.

08 Cover Songs & Licensing

If you wish to distribute a cover version of a song originally written by another artist, you must obtain the appropriate mechanical license before distributing the song through our platform. P Digital Network does not obtain mechanical licenses on behalf of artists.

Distributing a cover song without a valid mechanical license is a copyright infringement and may result in:

  • Removal of the release from all platforms.
  • A copyright strike on your account.
  • Legal liability to the original rights holder.

We recommend obtaining mechanical licenses through recognized licensing bodies before submitting cover songs for distribution.

09 False Claims

Submitting a false or fraudulent copyright claim is a serious matter. Under the DMCA and applicable law, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and legal fees.

P Digital Network reserves the right to terminate accounts of users who repeatedly file false or abusive copyright claims.

10 Changes to This Policy

P Digital Network reserves the right to update or modify this Copyright Policy at any time. Changes will be posted on this page with an updated revision date. We encourage you to review this policy periodically to stay informed about how we handle copyright matters.
